Trademarks and Related Rights

Arochi, Marroquín & Lindner handles all aspects of trademark practice as well as related rights such as trade names and domain names.

Our trademark professionals are skilled in searching and our opinions on those searches, assessing availability and registrability, provide clients with meaningful guidance.

In addition to registering marks, our practice includes all aspects of trademark maintenance, protection and enforcement of rights in matters before the Mexican Institute of Industrial Property (IMPI) and the courts. But, we do not stop there. We also assist our clients in maximizing the commercial value of their marks through the negotiation and drafting of licensing and franchising agreements and other commercial transactions involving transfers or authorization of user rights.

Our expertise extends beyond domestic Mexican law. We understand the Trade-related aspects of Intellectual Property Rights Agreement (TRIPS), the North American Free Trade Agreement (NAFTA), and other free trade agreements which include Intellectual Property Rights chapters and treaties specific to international trademark protection such as the Paris Convention and the Lisbon Agreement for Protection of Appellations of Origin. We are also knowledgeable about those intellectual property treaties to which Mexico is not a party because they may be relevant to our clients' interests.

Through our large network of international associates, we are able to obtain protection for our clients' marks throughout the world.
